SC full court reconstituted to hear CJP’s petition



ISLAMABAD:
The Acting Chief Justice of the Supreme Court Rana Bhagwandas on Monday
reconstituted full court of the highest judicial body of Pakistan after
Justice Falak Sher had refused to sit in the 14-judge full court.



Now the SC full court will comprise 13 judges Full court that will open
hearing on twenty-three constitutional petitions, including the
all-embracing filed by Chief Justice Iftikhar Muhammad Chaudhry
tomorrow (Tuesday).



The new SC full court, headed by Justice Khalilur Rehman Ramday,
comprises Justice Mohammad Nawaz Abbasi, Justice Faqir Mohammad
Khokhar, Justice Mian Shakirullah Jan, Justice M. Javed Buttar, Justice
Tassaduq Hussain Jillani, Justice Saiyed Saeed Ashhad, Justice Nasirul
Mulk, Justice Raja Fayyaz Ahmed, Justice Chaudhry Ijaz Ahmed and
Justice Syed Jamshed Ali and the ad hoc judges, Justice Hamid Ali Mirza
and Justice Ghulam Rabbani.

New reference against CJP should not be filed: S.M Zaffar





KARACHI:
Senator belonging to the ruling party S.M Zaffar has stressed the need
that new reference should not be filed against Chief Justice of
Pakistan Iftikhar Muhammad Chaudhry.


The government
should avoid preparation of any new file reference against Iftikhar
Muhammad Chaudhry, he said while talking to Geo News.



He also called upon Iftikhar Muhammad Chaudhry to delay attending
ceremonies of the Bar Associations till the decision of the Full Court
of the Supreme Court.

Justice Falak Sher refuses to sit in SC full court to hear CJP’s petition


ISLAMABAD:
Justice Falak Sher has refused to sit in the 14-judge full court of the
highest judicial body of Pakistan that opens hearing on twenty-three
constitutional petitions, including the all-embracing filed by Chief
Justice Iftikhar Muhammad Chaudhry today (Monday).


As
a result of the SC full court has been broken and the Acting Chief
Justice of the Supreme Court will re-constitute the SC full court.



“ I do not sit in the full court as a reference regarding seniority of
Iftikhar Muhammad Chaudhry is under trial in the Supreme Court,” said
Justice Falak Sher.



Headed by Justice Khalilur Rehman Ramday, the full court comprised
Justice Mohammad Nawaz Abbasi, Justice Faqir Mohammad Khokhar, Justice
Falak Sher, Justice Mian Shakirullah Jan, Justice M. Javed Buttar,
Justice Tassaduq Hussain Jillani, Justice Saiyed Saeed Ashhad, Justice
Nasirul Mulk, Justice Raja Fayyaz Ahmed, Justice Chaudhry Ijaz Ahmed
and Justice Syed Jamshed Ali and the ad hoc judges, Justice Hamid Ali
Mirza and Justice Ghulam Rabbani.





Full court takes up CJ's, others' petitions today



ISLAMABAD: A full court comprising 14-judges of the Supreme Court will
take up today (Monday) on daily basis, the constitutional petitions
filed by the Chief Justice of Pakistan, Justice Iftikhar Muhammad
Chaudhry and 23 others challenging the presidential reference,
formation of Supreme Judicial Council and President Musharraf's move to
file a reference against the Chief Justice.



Earlier, following the decision of a larger bench of the Supreme Court
headed by Justice M. Javed Battar, Acting Chief Justice Rana Bhagwan
Das on May 8 had constituted the full court headed by Justice
Khalil-ur- Rahman Ramday to hear the constitutional petitions of the
Chief Justice and others against the presidential reference.



Besides Justice Khalil-ur-Rahman Ramday, the full court
comprises-Justice Muhammad Nawaz Abbasi, Justice Faqir Muhammad
Khokhar, Justice Falak Sher, Justice Mian Shakirullah Jan, Justice M.
Javed Battar, Justice Tasadduq Hussain Jillani, Justice Syed Saeed
Ashhad, Justice Nasirul-ul-Mulk, Justice Raja Fayyaz Ahmad, Justice
Chaudhry Ijaz Ahmad, Justice Syed Jamshed Ali, Justice Hamid Ali Mirza
and Justice Ghulam Rabbani.



Acting Chief Justice Rana Bhagwan Das, Justice Javed Iqbal and Justice
Abdul Hameed Dogar being the members of the Supreme Judicial Council
(SJC) and Justice Sardar Muhammad Raza Khan, who earlier has declined
to hear the petitions, have not been included in the full court.



A panel of senior lawyers including- Chaudhry Aitzaz Ahsan, Munir A
Malik, Justice (r) Tariq Mehmood and Ali Ahmad Kurd will appear for
Chief Justice Iftikhar Muhammad Chaudhry.



Senior lawyers including- Syed Sharifuddin Pirzada, Waseem Sajjad,
Malik Qayyum, Dr Khalid Ranjha and Arif Chaudhry will represent the
referring authority.



Only those lawyers and advocate-on-records, whose cases will be fixed
for hearing before a bench of the apex court, will be allowed to enter
into the court premises.



Besides, only those media persons and other people, who own 'entry
pass' issued by the Registrar Supreme Court, will be allowed entry into
the courts.



During the course of proceedings of the full court, the Supreme Court
building will be guarded heavily by special policemen as well as
contingents of law enforcing crews.
